Terms of Use of the Finbooks Service

This website and all elements of any nature contained therein belong to XBOOKS LTD, company number 14060842, registered office address 1 Richmond Mews, Soho, London, England, W1D 3DA.

This document sets forth the conditions governing access to and use of the services offered by the Company. The use of this platform by any person as a user, whether a simple visitor or a subscribed user, constitutes unconditional acceptance of these Terms of Use.

The term "Provider" or "Company" refers to the entity that provides its services through the "Site" (meaning the website www.finbooks.com and the related webapp app.finbooks.com), while the term "User" refers to anyone who browses or uses the features made available.

SCOPE OF SERVICE AND PERMITTED USE. PROHIBITIONS.

The services provided by the Company may only be used for the purposes for which they are offered, in accordance with these Terms of Use and the General Terms and Conditions of Contract, in the event of purchase of the services proposed by the Provider.

The User undertakes to use them with the diligence of a prudent person, in accordance with the purposes for which they were offered and without any malicious intent or in violation of the rights of the Provider or third parties.

To this end, the Provider reserves the right to adopt any measure appropriate to protect its rights and interests, and in particular to deny the User access to the Site and/or its services, to terminate contracts, to report to the competent authorities any reprehensible activity carried out through the Site and/or its services whenever there is a suspicion that the Customer is committing violations of laws, regulations, third-party rights and/or the Contractual Conditions, including, by way of example and without limitation, any of the following activities:

  • Falsely claiming to meet any access requirement for the Site or use of the services, such as being of legal age;

  • Defaming, threatening, abusing, using intimidatory practices, threatening the Provider, its partners, collaborators, employees, or violating the rights of third parties in any other way;

  • Testing, analysing or probing the vulnerability of the Site, the services and the networks connected to the site, breaching the security or authentication procedures of the Webapp, the services and the networks connected to www.finbooks.com;

  • Installing, integrating, uploading or otherwise incorporating malware into or through www.finbooks.com or the webapp app.finbooks.com;

  • Using www.finbooks.com, the webapp app.finbooks.com and its technological infrastructure in an abusive, excessive or otherwise inappropriate manner (for example: for spam purposes);

  • Attempting to disrupt or tamper with the technological infrastructure in a manner that causes excessive damage or burden to the Site and its webapp;

  • Using the services in a manner that compromises the functionality and operational continuity of the Site and the services connected thereto.

The User undertakes, even in the case of access to so-called "unlimited" services, including the free email assistance service, to use them in an appropriate, fair and proportionate manner, so as to promote the operational continuity and adequate assistance of all users. In the event that the User makes excessive use of the services, the Company reserves the right to suspend or limit such use.

The User is expressly prohibited from implementing automated processes for the extraction, collection or capture of information, data and/or content, reverse engineering activities within the webapp and on www.finbooks.com and all related digital extensions, and any further activity aimed, directly or indirectly, at violating the industrial and intellectual property rights of the Provider.

It is likewise expressly prohibited to publish content or carry out activities that disrupt, interrupt, damage or otherwise violate the integrity of the Site and its webapp, or that, through the services offered by the Provider or its technological infrastructure, violate the devices of other Users. Such activities include: spamming, unlawful distribution of advertising, phishing, fraud against third parties, distribution of malware or viruses, etc.

Applicable Law and Competent Court

In the event that the User violates these Terms of Use, they shall be interpreted in accordance with Italian law; the elected court of competent jurisdiction is that of Bari.
